ROLES AND FUNCTIONS

Samoa Immigration’s main goal is to protect Samoa and promote economic development through:

  • Border Management
  • Issuance of Travel Documents
  • Granting of Samoan Citizenship, entry Permits, Temporary and Permanent Residency
  • Information Technology Development

  • Border Services: The issuance of visitor permits for foreign citizens traveling to Samoa for less than sixty days.
  • Citizenship Services: Grant of Samoan Citizenship, Renunciation of Samoan Citizenship, Review of Refusal of Citizenship, Issuance of certificate of Citizenship
  • Permit Services: Grant of Temporary Resident Permits.
  • Passport Services: Issuance of Travel Documents (Ordinary Passports, Official Passports, Diplomatic Passports, Document of Identity, Certificate of Identity)

BORDER SERVICES

MEETING US AT THE BORDERS

Any aircraft or vessel departing or arriving at any regulated port shall be attended by immigration officers for travel document screening on the spot. The process employs the first come first serve principle using the queuing system. Signs have been placed above the Immigration counters for public direction.

We are willing to give special treatment to:

  • Old age passengers.
  • Mothers with babies.
  • Medical and Disabilities.
  • Members of Diplomatic missions.
  • Special Ministerial cases.

An officer will be available to provide assistance to passengers. Arrival and Declaration Cards will also be provided either by Airline/Shipping Agent or by Immigration Officers at Arrival Booths.

Vessel Clearance:

The operator of every ship and aircraft about to arrive in or arriving in Samoa from some country or place outside Samoa shall deliver to the Officer on duty at such port or airport, as the case may require, prior to the ship or aircraft arriving at such port or airport or at such other time as the Minister may require a list of all persons on the ship or aircraft, including but not limited to the complete name, date of birth, nationality, and passport or other travel document number or details of every person on the ship or aircraft and such other information as the Minister may require in a form approved by the Minister; 62 Immigration 2004 2004, No. 4. Please use below forms for vessel clearance:

Foreign nationals who do not hold a valid Temporary Resident Permit or Samoan Citizenship will be issued with a free 60 days Visitors Permit upon arrival. But grant of Visitors permit is subject to our entry requirements i.e the passenger must:

  • have a return or onward ticket
  • possess a passport valid for a minimum of 6 months after the intended date of departure from Samoa.
  • have a valid visa or permit for entry into the country to which they will travel from Samoa.
  • state their accommodation arrangements, be they holiday accommodation such as a hotel or resort or with family or friends (specifically the village and family name)
  • have documented evidence of sufficient funds for self-support (typically a copy of a bank statement)
  • have no record or deportation from other countries
  • have no health problems that would pose a risk to Samoa
  • have no history of criminal charges resulting in a minimum of one year of sentencing; and
  • not be on any alert or warning lists.

Other Field Duties

On matters relating to overstaying and illegal entries, inspections and investigations are conducted in residential addresses and boarding houses for the purposes of:

  • Updating office records,
  • Follow up public compliance.

Minister may authorize in writing the Officers to enter and provide their identification to ensure lawful actions.

CITIZENSHIP SERVICES

Under the Citizenship Act 2004 Samoan citizenship can be acquired in four ways:

  1. By Birth: any person born in Samoa shall be a citizen of Samoa provided that at the time of the person’s birth at least one parent is a Samoan citizen
  2. By Decent: Any person born outside of Samoa shall be a citizen of Samoa by descent provided that at the time of the person’s birth at least one parent is:
    1. a Samoan citizen otherwise than by descent; or
    2. if one of the parents is a citizen by descent that parent has resided in Samoa for a period of 3 years or more at the time of the birth of the applicant (the residence does not have to be continuous)
  3. By Permanent Residence: An alien who has held a valid Samoan permanent residence permit for 5 years may apply to be registered as a Samoan citizen.
  4. By Marriage:
    1. Any person being an alien may apply to be registered as a citizen of Samoa by marriage to a Samoan citizen.
    2. Provided that the person has been married to and residing with the person’s husband or wife in Samoa or elsewhere for a period of 5 years

How can a person apply for Samoan Citizenship?

To be recognized as a Samoan Citizen, the relevant application form must be completed and lodged with the relevant fees at a Samoan Government Mission overseas or with the Immigration Division in Apia. Refer to Address details and Fee table.

Requirements for Samoan Citizenship applications:

  1. Citizenship by Descent
    • Evidence that at least one parent was a citizen of Samoa at the time of the birth of the applicant e.g a full birth certificate of the parent, or a Samoan Passport
    • Full Birth Certificate of the applicant to be registered showing details of the applicant to be recognized as a a citizen of Samoa by Descent
  2. Citizenship by Permanent Residence
    • Evidence of employment in Samoa over the past 5 years
    • Evidence of business and social activity in Samoa over past 5 years
    • Evidence of health and character status
  3. Citizenship by Marriage
    • Evidence of time living together with spouse over past 5 years
    • Evidence of the continuing nature of the marriage
  4. Additional requirements in some cases:
    • If there have been any changes to the name of the applicant or parent – evidence of those changes – marriage certificates, deed poll certificates, matai title certificates etc
    • If the parent of the person to be recognized is a citizen by descent, evidence that the parent has lived in Samoa for a total of at least 3 years – passport pages showing arrival and departure dates, school records in Samoa, employment records in Samoa etc

PERMIT SERVICES

Temporary Residence Information

Temporary Residence in Samoa can be issued for the following purposes:

      • • Business and Investment
        • Employment
        • Study
        • Academic Research
        • Cultural and Religious purposes
        • Family Support or Reunion

Visitors to Samoa can apply for a 60 day Visitor Permit on arrival using the arrival card. Travelers must have:

      • a passport valid for at least 6 months beyond the intended stay
      • confirmed onward tickets (Return Ticket)
      • visas for the next country of destination
      • sufficient funds to support themselves (while in Samoa)
      • confirmed residential contact address

Work is not permitted on a Visitor Permit. Visitors who are in Samoa and wish to apply for a further period of stay as a visitor should use the temporary residence form (MPMC100). A Business Visitor Permit is for persons normally employed and paid offshore who are visiting Samoa for a short visit, to visit a branch of their company, to conduct business negotiations with a Samoan company or to attend a business conference.

For other business activity in Samoa a Temporary resident Permit is required.

Temporary Resident Permit for conduct of business or invest in Samoa:

Investors need an Investment certificate from Ministry of Commerce, Industry and Labour and obtained a Business License from Ministry of Revenue and Company Registration confirmation from Ministry of Justice before applying for a Temporary Entry Permit.

Temporary Resident Permit for Employment:

•Attached Employer Sponsorship form (MPMC101)

• (A copy of the permit application will be forward to the Ministry of Labour who will recommend if employment of a non-citizen is in the best interests of Samoa.)

Temporary Resident Permit for Study in Samoa:

• Fill temporary residence permit form (MPMC100)
• Letter from education institution confirming enrollment (Medical Students – confirmation letter from Ministry of Health)
• Evidence of funds to support yourself
• If studying under a scholarship – a letter confirming details of award
(If a private student – evidence of accommodation arrangements)

Temporary Resident Permit for academic or scientific research in Samoa:

•Fill temporary residence permit form (MPMC100)
• Letter from your sponsoring academic institution to support research
• Letter from any academic institution in Samoa supporting research
• Evidence of funds for support while in Samoa, and travel out of Samoa
• Medical (MPMC102, MPMC103) and Police reports
•Entry permit MUST be approved and granted before travel to Samoa

Temporary Resident Permit for Cultural or Religious Purposes:

• Fill temporary residence permit form (MPMC100)
• Confirmation letter from organizers of the event
• Letter from hosts indicating accommodation arrangements
• Evidence of funds to support yourself

Temporary Resident Permit for Family Reunion or Family Support:

• Fill temporary residence permit form ( MPMC100)
• Statement describing the nature of the visit or confirmation letter from organizers of the event
• Letter from hosts indicating accommodation arrangements
• Evidence of funds to support yourself
• Medical (MPMC102, MPMC103) and Police reports

Application for further extension of Visitor Permit (60 days):

• Fill temporary residence permit form (MPMC100)
• Photocopy of onward ticket out of Samoa
• Evidence of funds for support while in Samoa
• Details of accommodation arrangements

MEDICAL REPORTS

A medical report is required for ALL persons intending to stay for 1 year or more.(for those over 16 years of age). A separate report is needed for each person traveling to Samoa.

POLICE REPORTS

A police report is required for ALL persons over 18 years intending to stay for 1 year or more. It should include police reports from authorities of every country you have lived in for more than 1 year in the last 5 years

Note on Employment:

It is an offense for a non-citizen to undertake employment in Samoa unless their Employment Permit specifically authorizes such employment.

Where a Temporary Resident Permit for Employment Purposes is granted, the holder is permitted to work for the employer nominated in the application. If this employment ceases for any reason, the Permit is subject to cancellation and the person must leave the country or apply for a new permit to remain in Samoa.

Visitors, Academic Researchers, Cultural and Religious personnel permit holders are not permitted to work in Samoa. Students may work part time, if authorized. Dependents of permit holders may seek authority to undertake employment in Samoa during the validity period of the principal applicant’s permit.

PASSPORT SERVICES

Applications for Samoan passports require 5 working days to process. A non-refundable fee is payable for the passport service.
Our objective is to make the process of obtaining a passport as simple as possible. To assist us in this objective we require your
cooperation in providing full details of the names you may legally use and the supporting documents appropriate to your circumstances.

Only SAMOAN CITIZENS are eligible for a Samoan passport.

  • Applicants must complete and sign the passport application form. Original or certified copies of
    appropriate supporting documents must be enclosed (Refer Section D – Checklist in application form).
  • Application of children under 16 years of age:
    a. Complete the consent form on Section C of the application form.
    b. Written consent from either parents or legal guardians is required.
